Terms + Conditions

The following Terms and Conditions of Service apply to all services provided by Our Mindful Marketing.

 

Our Mindful Marketing (OMM) offers a variety of services to improve a business’s online visibility. By engaging us, you agree to the Terms of Service set forth below. If you have questions, or if we may be of any service, please do not hesitate to contact us.

Abandoned Projects

A project shall be considered abandoned after 31 consecutive days have passed since the last productive communication received from the client. If the project surpasses 31 days from start date, due to failure of communication from client, the remaining 50% must be paid in full in order to move forward.

 

The project will be completed; however, the final 50% balance must be paid in full before OMM completes the project.

Binding

This Agreement shall be binding upon completion of the first payment.

Cancellations + Missed Meetings

Client agrees that it is the client's responsibility to notify OMM 12 hours in advance of the scheduled calls/meetings. OMM reserves the right to bill client for a missed meeting. We will attempt in good faith to reschedule the missed meeting.

Communication with OMM

Our preferred form of correspondence is via email (unless otherwise stated). We will do our very best to reply as soon as possible, however, please note that our standard for email response time is one full business day (24 hours).

Dispute Resolution

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and OMM agree to attempt to mediate in good faith for up to (specified amount of time, such as 30 days) after notice is given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party. 

Hours of Operation

Standard hours of operation at OMM are Monday-Friday, 9a-5p EST.

 

If you need to contact and communicate with a team member from OMM outside of normal hours of operation, please do so via email and we will do our best to reply as soon as possible.

Liability

The client also agrees that OMM holds no responsibility for any changes made by any third party, before or after a website is delivered.

Payment

At the time of approval of the quotation, the remainder of the amount due will become payable. Payments may be made via Credit Card, Debit Card or PayPal. Publication or release of work done by OMM on behalf of the client, may not take place before cleared funds have been received. Once payment has been made, there will be no reimbursement of funds unless agreed upon by OMM.

Project Acceptance

At the time of proposal, OMM will provide the client with an itemized quotation after completion of the initial consultation.

Time Frame and Delivery

Upon agreement, the scheduled start date  for the project will be 1-3 weeks from the specified date. This depends on OMM’s current volume of work. At the time of the client’s acceptance of the estimate or quote, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 50% of the quoted fee will be due immediately.

 

Work will not commence until OMM has received the deposit.

 

OMM has the right to refuse additional revisions. OMM will provide four revisions for website projects. OMM’s first draft to the client does count as a revision.

Warranty

We provide a thirty (30) day warranty period from the day the website is Published and Live to ensure that the website meets your originally agreed upon site specifications.

Wix Editor + Additional Fees

Wix allows one person on the Editor at a time. If you want to view the Editor before completion of the site - you must have approval from OMM beforehand

 

If another user accesses the Editor while a team member from OMM is making edits to the website, the client will be held responsible for an additional fee of $100, due to lost hours of work because of the non-approved sign in.
This fee must be paid in full before we move forward with the project.
