General Terms + Conditions

The following Terms and Conditions of Service also apply to all services provided by Our Mindful Marketing.


Our Mindful Marketing (OMM) offers a variety of services to improve a business’s online visibility. By engaging us, you agree to the Terms of Service set forth below. If you have questions, or if we may be of any service, please do not hesitate to contact us.

Cancellations + Missed Meetings

Client agrees that it is the client's responsibility to notify OMM 12 hours in advance of the scheduled call/meeting of any changes and/or cancellations. OMM reserves the right to bill client for a missed meeting.


We will attempt in good faith to reschedule the missed meeting.

Communication with OMM

Our preferred form of correspondence is via email (unless otherwise stated).


We will do our very best to reply as soon as possible, however, please note that our standard for email response time is one full business day (24 hours).

Digital Product Usage and Limited License

At any point should a Client, subscriber to our Newsletter, visitor to this website, and/or consumer of our content (and/or otherwise - hereinafter referred to as "the Individual") receive a PDF, video, guide, document, or any other type of medium/material from Our Mindful Marketing – the Individual is not allowed to reproduce and/or plagiarize any part of Our Mindful Marketing's product(s) or related communications for financial gain or otherwise.

Any and all materials, paid or free, that the Individual accesses on this or any related domains are the sole ownership or licensed use of Our Mindful Marketing LLC.

You are receiving a limited, non-transferable, non-exclusive, revocable license for non-commercial use only, in order to access any content or materials in the products the Individual has paid for or opted to receive.

If the Individual violates this license by giving or selling a copy of Our Mindful Marketing's template(s) and/or product(s) to anyone, Our Mindful Marketing reserves the right to send the Individual a bill for the licenses the Individual has sent to others and revoke your access to Our Mindful Marketing's template(s) and/or product(s) permanently. 

You may: 

  • Access the Individual's purchases and/or free content provided for personal use or for use in the Individual's business for non-commercial purposes. 

  • Download and/or print any purchases and/or free content provided for the Individual's personal use or in the Individual's business for non-commercial purposes.


You may NOT: 

  • Re-sell or trade access to the Individual's purchases. 

  • Share the purchase with anyone else who has not yet purchased it or opted in to receive it. 

  • Reprint or republish any of your purchases, in part or in whole. 

  • Reprint, republish or plagiarize the Our Mindful Marketing's offering, free content, or any other related materials and/or communications for financial gain or otherwise. 

  • Distribute any of the materials contained in the Individual's purchases or related materials and/or communications as the Individual's own, otherwise known as stealing. 

  • Reproduce and tweak any part or whole of the Individual's purchases for distribution as the Individual's own work. 

  • Claim ownership or use any of the Our Mindful Marketing's intellectual property without the prior consent, which includes (but is not limited to): copyrights such as course materials, worksheets, workbooks, lessons, videos, PDF guides, and more; trademarks such as names, logos, taglines, or other unique source identifiers; or trade dress including the look and feel of any of the Marketer’s offerings (and its related communications and materials). 

  • Use Our Mindful Marketing's offering or any related materials and/or communications in an unlawful way or for any illegal or unlawful purpose(s). 

Hours of Operation

Standard hours of operation are Monday-Friday, 9a-5p EST.


If you need to contact and communicate with a team member outside of our standard business hours of operation, please do so via email and we will do our best to reply as soon as possible.

Website Projects Terms + Agreement

Abandoned Projects

A project shall be considered abandoned after 31 consecutive days have passed since the last productive communication received from the Client. If the project surpasses 31 days from the start date, due to failure of communication from the Client, the remaining 50% must be paid in full in order to move forward.

The project will be completed; however, the final 50% balance must be paid in full before the Marketer completes the project. 


The Parties hereby agree not to assign any of the responsibilities in this Agreement to a third party unless consented by both Parties in writing. 


Upon project completion, the Marketer will hold onto content files for 90 days before deleting all content files pertaining to the Client’s project. 


The Client agrees that the Marketer holds no responsibility for any changes made by any third party, before or after a website is delivered. 

The Client also agrees that the Marketer holds no responsibility for any changes made by the Client during the timeline of the project.  


At the time of approval of the proposal, the remainder of the amount due will become payable.

Payments may be made via Credit Card, Debit Card, PayPal or Direct Deposit.

Publication or release of work completed by the Marketer on behalf of the Client may not take place before cleared funds have been received. Once payment has been made, there will be no reimbursement of funds unless agreed upon by the Marketer. 


It is in the Client’s best interest to maximize each revision as much as possible.

The Marketer has the right to refuse additional revisions. 

The Marketer will provide an initial draft or ‘first look’ and from there the Client will have the number of revisions stated on project proposal.

Terms of Agreement

The term of our Agreement (the "Term") will begin on the date agreed upon and will remain in full force and effect until the completion of the Services, subject to earlier termination as provided in this Agreement.

If either Party wishes to terminate this Agreement prior to the completion of the Services, that Party will be required to provide seven days' written notice to the other Party. 

The Term may be extended with the written consent of the Parties. 

Testimonials Disclaimer

In accordance with Federal Trade Commission’s 16 CFR, Part 255: “Guides Concerning the Use of Endorsements and Testimonials in Advertising concerning the use of endorsements and testimonials in advertising, please be aware of the following: 

Any testimonials left by the Client may be used for marketing and/or advertising purposes by the Marketer. 
The testimonials displayed are given verbatim except for grammatical or typing error corrections. Some testimonials may be edited for clarity or shortened in cases where the original testimonial included extraneous information that is of no relevance to the general public or advertisement. 


Please note that communication is vital during the time that we work together. In order for us to complete a project in a timely manner, communication is key. The timeline of a project is subject to change based on inactive communication from the Client.


This Agreement will be terminated immediately if one of the Parties breaches this Agreement.  

This Agreement may be terminated if the following occurs:

  • Abandoned Projects 

This Agreement will automatically be terminated when both Parties complete their obligations. 


We provide a thirty (30) day warranty period from the day the website is Published and Live to ensure that the website meets your originally agreed upon site specifications.

This does not include fixing changes made by a third party or the Client.  

Wix Editor & Projects

Wix allows one person on the Editor at a time. If the Client wants to view the Editor before completion of the site – the Client must have approval from the Marketer beforehand. 

If another user accesses the Editor while the Marketer is making edits to the website, the Client will be held responsible for an additional fee of $100, due to lost hours of work because of the non-approved sign in. This fee must be paid in full before the Marketer moves forward with the project.
